ข้อกำหนดนี้ทำขึ้นระหว่าง บริษัท มูทูเดย์ จำกัด (“เรา” หรือ “ผู้ให้บริการ”) กับผู้ใช้แอปพลิเคชัน Muketplace (“คุณ” หรือ “ผู้ใช้”) · การเข้าถึงหรือใช้งานแอปถือว่าคุณได้อ่าน เข้าใจ และตกลงผูกพันตามข้อกำหนดนี้ หากไม่ตกลง กรุณาหยุดใช้งานแอป
1. คำนิยาม
- แอป หมายถึง แอปพลิเคชันมือถือ Muketplace รวมถึงฟีเจอร์ ฟังก์ชัน และเนื้อหาทั้งหมดในนั้น
- เนื้อหา หมายถึง ข้อมูล ข้อความ รูปภาพ กราฟิก เสียง วิดีโอ ซอฟต์แวร์ และองค์ประกอบอื่น ๆ ที่ปรากฏบนแอป
- ผู้ขาย หมายถึง ร้านค้าหรือผู้ประกอบการที่นำสินค้ามาแสดงบนแพลตฟอร์ม
- ผู้เยี่ยมชม หมายถึง ผู้ใช้ที่ใช้แอปโดยไม่ได้เข้าสู่ระบบ
- บัญชี หมายถึง บัญชีที่เกิดขึ้นเมื่อคุณเลือกเข้าสู่ระบบด้วย Google หรือ Apple
2. ขอบเขตบริการของเวอร์ชันนี้
สิ่งที่แอปเวอร์ชันนี้ให้บริการ:
- ค้นหาและชมรายการสินค้า ร้านค้า และหมวดหมู่
- อ่านข้อมูลสินค้า ราคา และรีวิวที่ผู้ขายหรือผู้ซื้อรายอื่นให้ไว้
- กดถูกใจเพื่อเก็บสินค้าไว้ในรายการโปรด
- เปลี่ยนภาษา (ไทย / อังกฤษ / จีน) และตั้งชื่อที่แสดงของคุณเอง
- รายงานหรือบล็อกสินค้า ร้านค้า หรือรีวิวที่ไม่เหมาะสม
สิ่งที่แอปเวอร์ชันนี้ยังไม่มี: ตะกร้าสินค้า · การสั่งซื้อ · การชำระเงิน · การจัดส่ง · การคืนสินค้า/คืนเงิน · แชทกับร้าน · งานบริการสายมู
เราอาจเพิ่ม แก้ไข ระงับ หรือยุติฟีเจอร์ใด ๆ ของแอปได้ และไม่ได้ให้คำมั่นว่าฟีเจอร์ที่ยังไม่เปิดจะเปิดเมื่อใดหรือในรูปแบบใด
3. บัญชีผู้ใช้และการเข้าสู่ระบบ
- ไม่บังคับเข้าสู่ระบบ — ทุกฟีเจอร์ของเวอร์ชันนี้ใช้ได้ครบในโหมดผู้เยี่ยมชม
- ถ้าเลือกเข้าสู่ระบบ ทำได้ด้วย Google หรือ Sign in with Apple เท่านั้น — เราไม่มีการสมัครด้วยรหัสผ่านหรือเบอร์โทร
- สิ่งที่ได้เพิ่มจากการเข้าสู่ระบบคือ ชื่อที่แสดงและรายการโปรดตามตัวคุณไปทุกเครื่อง ไม่ใช่การปลดล็อกเนื้อหาที่ถูกซ่อนไว้
- คุณมีหน้าที่ดูแลความปลอดภัยของบัญชี Google หรือ Apple ที่ใช้เข้าสู่ระบบ และรับผิดชอบการใช้งานที่เกิดขึ้นผ่านบัญชีนั้น
- คุณลบบัญชีและข้อมูลได้เองตลอดเวลา (ดู หน้าลบบัญชีและข้อมูล)
4. อายุผู้ใช้
แอปนี้มีไว้สำหรับผู้ใช้ที่มีอายุ 18 ปีขึ้นไป หากคุณอายุต่ำกว่านั้น กรุณาอย่าใช้แอปและอย่าเข้าสู่ระบบ
5. ข้อมูลสินค้าและความรับผิดชอบของผู้ขาย
- Muketplace เป็น ตลาดกลาง — ผู้ขายแต่ละร้านเป็นผู้รับผิดชอบสินค้า รูปภาพ และคำอธิบายของตนเอง เราไม่ใช่ผู้ขายสินค้าที่แสดงบนแพลตฟอร์ม
- ข้อมูลสินค้า ราคา และความพร้อมจำหน่ายมาจากผู้ขาย จึงเปลี่ยนแปลงหรือคลาดเคลื่อนได้
- เราไม่ได้ตรวจสอบความแท้ของวัตถุมงคลแทนคุณ และไม่ได้ให้บริการประเมินราคาหรือออกใบรับรอง
- ในเวอร์ชันนี้ ราคาที่แสดงมีไว้เพื่อประกอบการตัดสินใจเท่านั้น ไม่ใช่คำเสนอขายที่ผูกพัน และการซื้อขายไม่ได้เกิดขึ้นในแอป · หากคุณติดต่อผู้ขายผ่านช่องทางอื่นนอกแอป ธุรกรรมนั้นเป็นเรื่องระหว่างคุณกับผู้ขายโดยตรง เราไม่ใช่คู่สัญญาและไม่รับผิดชอบต่อผลของธุรกรรมดังกล่าว
6. ไม่มีการรับประกันผลลัพธ์
สินค้าและเนื้อหาบนแพลตฟอร์มเกี่ยวข้องกับความเชื่อส่วนบุคคล · ทั้งเราและผู้ขายไม่รับประกันผลลัพธ์ใด ๆ เช่น โชคลาภ ความสำเร็จ ความสัมพันธ์ สุขภาพ หรือผลทางการเงิน และเนื้อหาบนแอปไม่ใช่คำแนะนำทางการแพทย์ การเงิน กฎหมาย หรือวิชาชีพอื่น หากคุณมีปัญหาสุขภาพหรือปัญหาทางกฎหมาย กรุณาปรึกษาผู้ประกอบวิชาชีพโดยตรง
7. การใช้งานที่ยอมรับได้
คุณตกลงว่าจะไม่:
- ใช้แพลตฟอร์มเพื่อเรี่ยไรหรือรับบริจาค
- เผยแพร่เนื้อหาที่ผิดกฎหมาย หลอกลวง ละเมิดสิทธิผู้อื่น หรือสร้างความเกลียดชัง
- เสนอขายสิ่งที่กฎหมายห้าม หรือของที่ได้มาโดยมิชอบ
- สวมรอยเป็นบุคคลอื่น ร้านค้าอื่น หรือแอบอ้างว่าเกี่ยวข้องกับเรา
- ดึงข้อมูลอัตโนมัติจำนวนมาก (scraping) ทำวิศวกรรมย้อนกลับ เจาะระบบ หรือรบกวนการทำงานของบริการ
- ใช้แอปในทางที่ขัดต่อกฎหมายไทยหรือกฎหมายที่ใช้บังคับกับคุณ
8. การรายงานเนื้อหา การบล็อก และการระงับ
- คุณรายงานสินค้า ร้านค้า หรือรีวิวที่ไม่เหมาะสมได้จากปุ่มรายงานในแอป
- คุณบล็อกร้านหรือรีวิวได้เอง — สิ่งที่บล็อกจะถูกกรองออกจากสิ่งที่คุณเห็นบนเครื่องนั้น
- เมื่อได้รับรายงาน เราจะพิจารณาและอาจนำเนื้อหาออก หรือระงับการแสดงร้านนั้น · เรายังไม่มีทีมตรวจสอบตลอด 24 ชั่วโมงและไม่มีระบบกรองข้อความอัตโนมัติ จึงไม่รับประกันเวลาในการตอบสนอง
9. ทรัพย์สินทางปัญญา
ชื่อ Muketplace โลโก้ ส่วนติดต่อผู้ใช้ และซอฟต์แวร์ของแอปเป็นของเราหรือผู้ให้อนุญาตของเรา · รูปภาพและคำอธิบายสินค้าเป็นของผู้ขายหรือเจ้าของสิทธิ์รายนั้น · ห้ามทำซ้ำ ดัดแปลง หรือนำไปใช้เชิงพาณิชย์โดยไม่ได้รับอนุญาตเป็นลายลักษณ์อักษร · หากคุณเห็นว่ามีเนื้อหาละเมิดสิทธิ์ของคุณ แจ้งเราได้ที่อีเมลในข้อ 16
10. ข้อมูลส่วนบุคคล
การเก็บและใช้ข้อมูลส่วนบุคคลเป็นไปตาม นโยบายความเป็นส่วนตัว ซึ่งถือเป็นส่วนหนึ่งของข้อกำหนดนี้ · โดยสรุป เวอร์ชันนี้เก็บข้อมูลการใช้งานแอป ตัวระบุอุปกรณ์ ข้อมูลประสิทธิภาพ และรายงานข้อขัดข้อง และเก็บชื่อที่แสดงกับอีเมลเพิ่มเฉพาะผู้ที่เลือกเข้าสู่ระบบ
11. ความพร้อมของบริการและข้อจำกัดความรับผิด
- เราให้บริการแอปตามสภาพที่เป็นอยู่ และอาจหยุดให้บริการชั่วคราวเพื่อปรับปรุงระบบหรือด้วยเหตุสุดวิสัย
- เราไม่รับประกันว่าแอปจะทำงานต่อเนื่องไม่ติดขัด ปราศจากข้อผิดพลาด หรือว่าข้อมูลจากผู้ขายจะถูกต้องครบถ้วนตลอดเวลา
- เท่าที่กฎหมายอนุญาต เราไม่รับผิดต่อความเสียหายทางอ้อม ความเสียหายสืบเนื่อง การขาดกำไร หรือการสูญหายของข้อมูล อันเกิดจากการใช้หรือไม่สามารถใช้แอป
- ข้อจำกัดข้างต้นไม่กระทบสิทธิที่คุณมีตามกฎหมายคุ้มครองผู้บริโภคของไทย และไม่ยกเว้นความรับผิดในกรณีจงใจหรือประมาทเลินเล่ออย่างร้ายแรง
12. ฟีเจอร์ที่จะเปิดในอนาคต
ระบบสั่งซื้อ ชำระเงิน จัดส่ง แชทกับร้าน และงานบริการสายมู จะเปิดในเวอร์ชันถัดไป · เมื่อเปิดใช้จริง จะมีข้อกำหนดเพิ่มเติม (เช่น เงื่อนไขการสั่งซื้อ การคืนสินค้า/คืนเงิน และเงื่อนไขของผู้ให้บริการรับชำระเงิน) แสดงให้คุณอ่านและยอมรับก่อนเริ่มใช้ · ข้อกำหนดฉบับนี้ไม่ได้ให้สิทธิ์หรือคำสัญญาใด ๆ เกี่ยวกับฟีเจอร์เหล่านั้น
13. การเปลี่ยนแปลงข้อกำหนด
เราอาจแก้ไขข้อกำหนดนี้เมื่อบริการเปลี่ยนไปหรือเมื่อกฎหมายกำหนด · ฉบับล่าสุดจะอยู่บนหน้านี้เสมอพร้อมวันที่ที่ปรับปรุง · หากเป็นการแก้ไขสาระสำคัญ เราจะแจ้งในแอปด้วย · การใช้แอปต่อหลังการแก้ไขถือว่าคุณยอมรับฉบับใหม่
14. การยุติการใช้งาน
คุณเลิกใช้บริการได้ทุกเมื่อ โดยลบบัญชีและข้อมูลในแอป หรือถอนการติดตั้งแอป · เราอาจระงับหรือยุติการให้บริการแก่ผู้ใช้ที่ละเมิดข้อกำหนดนี้หรือใช้แอปในทางที่ผิดกฎหมาย
15. กฎหมายที่ใช้บังคับ
ข้อกำหนดนี้อยู่ภายใต้กฎหมายไทย และข้อพิพาทที่เกิดขึ้นให้อยู่ในเขตอำนาจของศาลไทย

Terms of service — Muketplace
These terms are an agreement between บริษัท มูทูเดย์ จำกัด (MUToday, a company registered in Thailand — “we”, “us”) and the users of the Muketplace app (“you”). By accessing or using the app you confirm that you have read, understood and agreed to be bound by these terms. If you do not agree, please stop using the app.
1. Definitions
- App — the Muketplace mobile application, including all of its features, functionality and content.
- Content — data, text, images, graphics, audio, video, software and any other element shown in the app.
- Seller — a shop or business that lists products on the platform.
- Guest — a user who uses the app without signing in.
- Account — the account created when you choose to sign in with Google or Apple.
2. Scope of this version
What this version of the app provides:
- Searching and browsing products, shops and categories.
- Reading product details, prices and reviews provided by sellers or other buyers.
- Saving products to your favourites.
- Switching language (Thai / English / Chinese) and setting your own display name.
- Reporting or blocking products, shops or reviews you find inappropriate.
What this version does not have: cart · ordering · payment · delivery · returns or refunds · shop chat · spiritual services.
We may add, change, suspend or discontinue any feature, and we make no promise about when or in what form features that are not yet available will open.
3. Accounts and signing in
- Signing in is optional — every feature of this version works fully in guest mode.
- If you do sign in, the only methods are Google and Sign in with Apple. We have no password or phone-number sign-up.
- What signing in adds is that your display name and favourites follow you across devices — it does not unlock hidden content.
- You are responsible for the security of the Google or Apple account you sign in with, and for activity carried out through it.
- You can delete your account and data at any time (see the account deletion page).
4. Age requirement
The app is intended for users aged 18 or over. If you are younger, please do not use the app and do not sign in.
5. Product information and seller responsibility
- Muketplace is a marketplace: each seller is responsible for their own items, images and descriptions. We are not the seller of the items shown on the platform.
- Product details, prices and availability come from sellers, so they may change or be inaccurate.
- We do not authenticate amulets on your behalf, and we do not provide valuation or certification services.
- In this version, displayed prices are for information only — they are not a binding offer, and no sale takes place in the app. If you contact a seller through a channel outside the app, that transaction is strictly between you and the seller; we are not a party to it and are not responsible for its outcome.
6. No guarantee of outcomes
The items and content on the platform relate to personal belief. Neither we nor sellers guarantee any outcome — such as luck, success, relationships, health or financial results — and nothing in the app is medical, financial, legal or other professional advice. For health or legal matters, please consult a qualified professional.
7. Acceptable use
You agree not to:
- Use the platform to solicit or collect donations.
- Publish illegal or deceptive content, content that infringes the rights of others, or hateful content.
- Offer items that are prohibited by law or that were obtained unlawfully.
- Impersonate another person or shop, or falsely claim an association with us.
- Scrape data at scale, reverse-engineer, attack or otherwise interfere with the service.
- Use the app in any way that breaks Thai law or the law that applies to you.
8. Reporting, blocking and removal
- You can report a product, shop or review from the report button in the app.
- You can block a shop or a review yourself — blocked items are filtered out of what you see on that device.
- When we receive a report we review it and may remove the content or hide the shop. We do not operate a 24/7 moderation team and there is no automated message filter, so we cannot guarantee a response time.
9. Intellectual property
The Muketplace name, logo, user interface and software belong to us or our licensors. Product images and descriptions belong to the relevant seller or rights holder. They may not be copied, modified or used commercially without written permission. If you believe content on the app infringes your rights, contact us at the address in section 16.
10. Personal data
Collection and use of personal data is governed by our privacy policy, which forms part of these terms. In short, this version collects app interaction data, a device identifier, performance data and crash reports, and additionally stores a display name and email address only for users who choose to sign in.
11. Availability and limitation of liability
- The app is provided “as is” and may be temporarily unavailable for maintenance or reasons beyond our control.
- We do not warrant that the app will run without interruption or error, or that seller-supplied information is always accurate and complete.
- To the extent permitted by law, we are not liable for indirect or consequential damages, loss of profit or loss of data arising from use of, or inability to use, the app.
- Nothing above limits the rights you have under Thai consumer protection law, and it does not exclude liability for wilful misconduct or gross negligence.
12. Features planned for the future
Ordering, payment, delivery, shop chat and spiritual services are planned for a future version. When they open, additional terms (for example ordering conditions, returns and refunds, and the payment provider's own terms) will be shown for you to read and accept first. These terms grant no rights and make no promises regarding those features.
13. Changes to these terms
We may update these terms as the service changes or as the law requires. The current version is always on this page with its date. For material changes we will also notify you in the app. Continuing to use the app after a change means you accept the new version.
14. Ending your use
You may stop using the service at any time by deleting your account and data in the app, or by uninstalling the app. We may suspend or end service for users who breach these terms or use the app unlawfully.
15. Governing law
These terms are governed by Thai law, and disputes fall under the jurisdiction of the courts of Thailand.

本条款由泰国注册公司 บริษัท มูทูเดย์ จำกัด（MUToday，以下称“我们”）与 Muketplace 应用的用户（以下称“您”）订立。访问或使用本应用即表示您已阅读、理解并同意受本条款约束； 若不同意，请停止使用本应用。
1. 定义
- 应用：指 Muketplace 移动应用，包括其中的全部功能与内容。
- 内容：指应用中呈现的数据、文字、图片、图形、音频、视频、软件及其他要素。
- 店铺：指在平台上展示商品的商家或经营者。
- 访客：指未登录即使用应用的用户。
- 账号：指您选择使用 Google 或 Apple 登录时所产生的账号。
2. 本版本的服务范围
本版本提供：
- 搜索并浏览商品、店铺与分类。
- 查看商品信息、价格，以及店铺或其他买家提供的评价。
- 收藏喜欢的商品。
- 切换语言（泰文／英文／中文）并自行设置显示名称。
- 举报或屏蔽不当的商品、店铺或评价。
本版本尚未提供：购物车 · 下单 · 付款 · 配送 · 退货退款 · 与店铺聊天 · 开运服务。
我们可以新增、修改、暂停或终止任何功能，且不承诺尚未开放的功能将于何时、以何种形式推出。
3. 账号与登录
- 登录并非必需 —— 本版本的全部功能以访客身份均可完整使用。
- 如选择登录，仅支持 Google 与 Apple 登录；我们没有密码或手机号注册方式。
- 登录带来的差别是显示名称与收藏可在多台设备间同步，而非解锁被隐藏的内容。
- 您应自行保管用于登录的 Google 或 Apple 账号，并对通过该账号进行的操作负责。
- 您可随时删除账号与数据（见删除账号页面）。
4. 年龄要求
本应用面向 18 周岁及以上的用户。若您未满该年龄，请勿使用本应用，也请勿登录。
5. 商品信息与店铺责任
- Muketplace 是交易平台：各店铺自行对其商品、图片与描述负责；平台上展示的商品并非由我们出售。
- 商品信息、价格与库存均来自店铺，因此可能变动或存在误差。
- 我们不代您鉴定法物真伪，也不提供估价或出具证书的服务。
- 本版本所显示的价格仅供参考，不构成具有约束力的要约，交易也不在应用内完成。若您通过应用以外的渠道与店铺联系，该交易完全发生在您与店铺之间，我们并非合同一方，亦不对其结果负责。
6. 不保证任何结果
平台上的商品与内容涉及个人信仰。我们与店铺均不保证任何结果， 例如财运、成功、感情、健康或财务收益；应用中的内容也不构成医疗、财务、法律或其他专业建议。 如遇健康或法律问题，请直接咨询相关专业人士。
7. 可接受的使用方式
您同意不得：
- 利用平台募捐或收受捐款。
- 发布违法或具欺骗性、侵害他人权利或散播仇恨的内容。
- 提供法律禁止的物品或来源不正当的物品。
- 冒充他人或其他店铺，或谎称与我们存在关联。
- 大规模抓取数据、反向工程、攻击或以其他方式干扰服务运行。
- 以违反泰国法律或对您适用之法律的方式使用本应用。
8. 举报、屏蔽与下架
- 您可通过应用内的举报按钮举报商品、店铺或评价。
- 您也可自行屏蔽店铺或评价，被屏蔽的内容将在该设备上从您所见的列表中过滤掉。
- 收到举报后我们会进行审核，并可能下架相关内容或暂停显示该店铺。我们没有 24 小时审核团队，也没有自动消息过滤系统，因此无法保证处理时限。
9. 知识产权
Muketplace 名称、标识、界面与软件归我们或我们的许可方所有；商品图片与描述归相应店铺或权利人所有。 未经书面许可，不得复制、修改或用于商业用途。若您认为应用中的内容侵犯了您的权利，请通过第 16 条的邮箱与我们联系。
10. 个人数据
个人数据的收集与使用适用我们的隐私政策，该政策构成本条款的一部分。 简言之，本版本收集应用使用行为、设备标识、性能数据与崩溃报告； 仅对选择登录的用户，另外保存显示名称与邮箱。
11. 服务可用性与责任限制
- 本应用按“现状”提供，可能因维护或不可抗力而暂时无法使用。
- 我们不保证应用运行不中断、无错误，也不保证店铺提供的信息始终准确完整。
- 在法律允许的范围内，对于因使用或无法使用本应用而产生的间接损失、后果性损失、利润损失或数据丢失，我们不承担责任。
- 上述限制不影响您依泰国消费者保护法享有的权利，亦不免除故意或重大过失的责任。
12. 未来将开放的功能
下单、付款、配送、与店铺聊天以及开运服务计划在后续版本开放。届时会先向您展示 补充条款（例如下单条件、退货退款规则以及支付服务商自身的条款），供您阅读并同意后方可使用。 本条款不就上述功能授予任何权利或作出任何承诺。
13. 条款变更
当服务发生变化或法律要求时，我们可能更新本条款。最新版本连同更新日期始终发布于本页； 如属重大变更，我们还会在应用内通知您。变更后继续使用本应用，即视为您接受新版本。
14. 终止使用
您可随时在应用内删除账号与数据，或卸载应用，以停止使用本服务。 对于违反本条款或以违法方式使用应用的用户，我们可暂停或终止提供服务。
15. 适用法律
本条款适用泰国法律，相关争议由泰国法院管辖。
